CrunchDAO Privacy Policy

Welcome to the CrunchDAO Privacy Policy. This policy explains how Crunch Foundation, a foundation company incorporated in the Cayman Islands ("we," "us," or "Crunch Foundation"), collects, uses, and shares your personal information (or any personal information you provide on behalf of others) when you use the CrunchDAO website, platform, and related services (the "Services"). For the purposes of the Cayman Islands Data Protection Act ("DPA"), General Data Protection Regulation ("GDPR") and other applicable data protection laws (together, the "Data Protection Legislation"), Crunch Foundation is the data controller of your personal information.

We collect information to provide better Services to all our users. When you’re not signed into a CrunchDAO account, we store the information we collect with unique identifiers tied to the browser, application, or device you’re using. When you’re signed in, we collect information that we store with your CrunchDAO account.
When you create a CrunchDAO account, submit competition entries or otherwise use the Services, you may provide us with personal information that includes your name and a password. You may also provide your mailing address and home/mobile phone number, or other personal information.
Your provision of this personal data is required for you to enter into the Terms of Use, a contract with us, as well as for you to enter competitions hosted on the Services. These entries are also a contract between you and the competition host, and we need your personal information to host the Services offered under that contract (see the Terms of Use for additional information). If you do not provide the minimum amount of personal data required to register an account, including your name and email address, you cannot use the Services, as this information is necessary for contractual reasons. Certain parts of the Services also require you to provide a mobile phone number, which is needed to protect against fraud and abuse.
We also collect the content you create, upload, or receive from others when using our Services. This includes things like messages you write and receive, forum posts, notebooks, datasets, and competition submissions.
Crunch Foundation uses the information we collect for the following purposes:
We use your information to deliver our Services, like administering competitions you enter or hosting datasets you upload or access. For example, we use the IP address assigned to your device to send you the data you requested, such as loading a dataset.
Another example is that we use unique identifiers stored in cookies on your device to help us authenticate you as the person who should have access to your CrunchDAO account.
We also use your information to ensure our Services are working as intended, such as tracking outages or troubleshooting issues that you report to us. And we use your information to make improvements to our Services – for example, to understand and analyze the usage trends and preferences of our CrunchDAO account members and to improve the way the Services work and look.
We use the information we collect in existing Services to help us create new features and functionality.
We use the information we collect to customize our Services for you, including remembering your information so that you will not have to log in again the next time you visit the Services if you haven’t signed out. We also use data to provide customized third party content and information and to track your status in any Competitions or other activities.
We engage third-party advertising partners to display ads promoting our services, including on social media platforms, search engines, and across the web. We use the information we collect to target our ads to you or others that may be interested. For example, if you visit our Services, we may retarget ads to you on social media based, and we may work with social media platforms and other advertising partners to serve ads to other individuals that may be interested in similar listings. We use data for analytics and measurement to understand how our Services are used and to measure the performance of our advertising. We use a variety of tools to do this, including Google Analytics. Google Analytics relies on first-party cookies, which means the cookies are set by Crunch Foundation. You can opt-out from Google Analytics by downloading and installing the browser plug-in available at: https://tools.google.com/dlpage/gaoptout.
We use information we collect, like your email address, to interact with you directly. For example, we may send you a notification if we detect suspicious activity on your account, or let you know about upcoming changes. We will also use your email address to contact you with respect to competition entries, prize awards; for administrative and customer service purposes; to address intellectual property infringement, rights of privacy, or defamation issues; or regarding things you post on the Services. You will have the ability to opt-out of receiving any such non-essential communications by updating your Member Account settings.
We use information to help improve the safety and reliability of our Services. This includes detecting, preventing, and responding to fraud, abuse, security risks, and technical issues. We also analyze your content to help us detect abuse such as spam, malware, and illegal content. When we detect violations of our policies, we may disable your account or take other appropriate action, including reporting the violation to appropriate authorities.
We may use personal information to comply with regulatory, governmental, tax and law enforcement authorities. We may also use personal information to conduct due diligence on you or when carrying out internal checks and audits.

When you’re signed into your CrunchDAO account, you can always review and update information by visiting your account profile.
You can export a copy of content if you want to back it up or use it with a service outside of CrunchDAO by contacting us. You may update, correct, or delete your profile information and preferences at any time by accessing your account settings page. If desired, you can delete your entire CrunchDAO account by choosing that option in your account settings page.
Please note that while your deletions are reflected promptly in active member databases, in some cases, we retain data for limited periods when it needs to be kept for legitimate business or legal purposes.
Many of our Services let you share information with other people, and you have control over how you share. Any information that you voluntarily choose to include in a public area of the Services (like a public profile page or forum posting) will be available to the public. We urge CrunchDAO members to exercise common sense and prudence about what information to make available to others.
We do not sell your personal information. We disclose your personal information in connection with developing and maintaining the Services and operating Competitions:
Crunch Foundation is located in the Cayman Islands, and we utilize infrastructure, service providers, and operating affiliates (including development companies) located in the United States and other global jurisdictions. Therefore, your personal information may be transferred to, stored, and processed in countries that do not offer equivalent protection of personal information as under the Data Protection Legislation. In such cases, we rely on standard contractual clauses or other legally approved transfer mechanisms to ensure your data remains protected and to ensure data information is processed in accordance with Data Protection Legislation.
You can exercise your right to request access to, correct, remove, and restrict the processing of your personal information (in certain circumstances). You also have the right to be informed about the purposes for which your personal information is processed, object to the processing of your information, request that your personal data be deleted (in certain circumstances) or export your information to another service.

We will only use your personal information in pursuance of our legitimate interests where we have considered that the use is necessary and, on balance, our legitimate interests are not overridden by your legitimate interests, rights or freedoms.
We will not take decisions producing legal effects concerning you, or otherwise significantly affecting you, based solely on automated processing of your personal information, unless we have considered the proposed processing in a particular case and concluded in writing that it meets the applicable requirements under the Data Protection Legislation.

The Services contain links to websites and services provided by third parties. We are not responsible for the content or privacy and security practices of third-party sites. We encourage you to learn about their policies before providing them with personal information.
Crunch Foundation uses a variety of physical, managerial, and technical safeguards designed to improve the security of our systems and your personal information. You also have the right to be informed of a personal data breach (unless the breach is unlikely to be prejudicial to you).
We change this Privacy Policy from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent. We always indicate the date the last changes were published, and if changes are significant, we will provide a more prominent notice.
